AVI CHAI’s Trustees approved a two-year grant to place a fellow within the Becket Fund to work on cases that challenge the Blaine Amendment and similar laws in many states that prohibit/limit government funding for religious schools. To the extent the Fellow cannot fill his time productively with such cases, attention would turn to (1) upholding the autonomy of religious schools to internally apply their religious standards in admissions, hiring, etc.; and (2) ensuring that day schools receive the zoning treatment they deserve under the Religious Land Use and Institutionalized Persons Act of 2000 (“RLUIPA”).
